A California federal judge has dismissed two claims in a proposed class action alleging that Costco Wholesale Corp. misled consumers by mislabeling products in its Kirkland Signature food line.
Judge Beth Labson Freeman of the U.S. District Court for the Northern District of California granted Costco’s partial motion to dismiss two causes of action—breach of the implied warranty of merchantability and negligent misrepresentation—that were asserted for the first time in plaintiff Lisa Liddle's third amended complaint.
