A California federal judge has sided with online customers of Safeway Inc., who alleged in a class action that the store breached its contract by charging them more for groceries they ordered on the Internet than had they made the purchases in a store.

U.S. District Judge Jon Tigar of the Northern District of California granted partial summary judgment to Pennsylvania plaintiff Michael Rodman, who alleged that Safeway “secretly” applied markups to items sold for delivery without clearly disclosing the practice. The judge ordered the grocery chain to repay delivery customers the extra money they were charged.
