The Supreme Court of Oklahoma has ruled a trial court judge abused his discretion when he awarded $7 million to plaintiffs’ lawyers when the total settlement award was only $46,000 total for Volkswagen owners in a class action over an alleged body defect.
Oklahoma’s highest court on Dec. 16 reversed and remanded the case of Hess v. Volkswagen to Pottawatomie County District Court, where Judge Douglas Combs in 2012 calculated that the fee award—even though it was 150 times that of the class members’ recovery—was appropriate.
