A Louisiana state judge agreed to dismiss a class certification motion in a toxic chemical suit, echoing a state Supreme Court decision that found similarly situated plaintiffs were too differently affected by a gas leak to seek classwide damages.

The suit in Civil District Court for the Parish of Orleans involves an incident in May 2000, when the New Orleans Fire Department heard reports of odors around railroad tracks operated by Norfolk Southern Railway Co near the Louisiana State University Dental School.
