A divided federal appeals panel has grounded a proposed class action alleging United Airlines ripped off members of its “Million Mile Flyer” club following a merger by downgrading what had been billed as “lifetime” benefits.

In a 2-1 decision, the three judge panel of the U.S. Court of Appeals for the Seventh Circuit found on Dec. 22 in favor of United Continental Holdings Inc. and United Airlines, which had argued that the contract between the airline and its “Mileage Plus” customers allowed United to change the program’s terms at any time.
