A California federal judge has thrown out a proposed class action accusing Michigan-based Gerber Products Co. of making unlawful and misleading claims on its baby food labels.
Judge Lucy Koh of the U.S. District Court for the Northern District of California granted Gerber’s motion for summary judgment, saying the plaintiff failed to provide evidence the public or targeted consumers could be misled by the nutrient and content claims on Gerber products.
