A California federal judge has denied Hyland’s Inc. motion for summary judgment in a class action alleging the company misrepresents that its homeopathic products fight colds and influenza quickly and effectively.

Judge George King of the U.S. District Court for the Central District of California refused to throw out the suit, rejecting the motion by the 100-year-old California homeopathic remedy company arguing that the plaintiffs’ state law claims are preempted by the U.S. Food and Drug Administration and the Food, Drug and Cosmetic Act (FDCA), a Jan. 12 court order stated.
