Wal-Mart Stores Inc. has become the second national retailer to be sued over a recent, multi-state Listeria outbreak caused by consumers eating caramel apples contaminated with the bacteria.

The Jan. 13 complaint was filed in the Superior Court of Sacramento County, Calif., on behalf of Darlene Vouri, who became seriously ill after eating the apples, and her husband Francis Vouri against Wal-Mart of Bentonville, Arkansas, apple supplier Bidart Brothers Apple Packing Co. of Shafter, Calif., and caramel apple manufacturer Happy Apple Co. Inc. of Union, Missouri.
