A federal appeals court has paved the way for a malpractice class action against Milberg LLP brought by clients who sued the law firm over a botched securities fraud case.
Reversing a district court ruling that denied class certification to the plaintiffs, Thursday’s decision from the U.S. Court of Appeals for the Ninth Circuit stems from a case filed by Columbia Law School professor Philip Bobbitt. He alleged that New York-based Milberg, former founding partner Melvyn Weiss and three other law firms bungled his securities fraud case against Variable Annuity Life Insurance Company Inc.
