A federal appeals court has upheld attorney Marc Garrett Rosenthal’s criminal conviction for his role in a fraud and bribery scheme that involved a former Texas state lawmaker and a former state judge.

On Oct. 14, the U.S. Court of Appeals for the Fifth Circuit rejected Rosenthal’s three-pronged procedural attack. Rosenthal sought a new trial because of Texas federal court rulings that allowed government recordings of his telephone calls to be part of the trial. He also challenged three jury instructions and a government statement about Judge Abel Limas’ guilty plea during its rebuttal closing argument.
