The Dow Chemical Co. has agreed to pay $835 million to settle price-fixing litigation over urethane sales, citing uncertainties about the prospects of class actions before the U.S. Supreme Court given the death of Justice Antonin Scalia.

Friday’s announcement comes as Dow, represented by Carter Phillips of Sidley Austin, had petitioned the U.S. Supreme Court to overturn a $1.06 billion judgment against it in multidistrict litigation brought by a class of purchasers of urethane, which is used in everything from mattress pads to car seats.
