“With the filing of these two suits, EEOC is continuing to solidify its commitment to ensuring that individuals are not discriminated against in workplaces because of their sexual orientation,” said EEOC General Counsel David Lopez, in a prepared statement. “While some federal courts have begun to recognize this right under Title VII, it is critical that all courts do so .”

The commission alleged in one complaint that lesbian woman was fired from her job as a forklift operator at IFCO Systems NA Inc. after complaining about comments related to her sexual orientation and, at one point, leaving work early after being unable to endure the harassment.

The company’s night shift manager made comments such as “I want to turn you back into a woman,” “Are you a man or a woman?” and “I want you to like men again,” according to the complaint filed in the U.S. District Court for Maryland.
