Attorney Dwain Downing wanted the “Saturday Special” at “Our Place Restaurant” in Mansfield, Texas, a short drive from Fort Worth. The special comes with an entree, two sides and soup. Or so Downing thought.
After receiving his meal sans soup — and with no accompanying replacement or discount — he threatened a lawsuit over alleged deceptive trade practices. Downing, according to ABC affiliate WFAA in Dallas, sent a letter to the Our Place owner Benji Arslanovksi that demanded, among other things: $2.25 in damages and $250 in attorney fees. “The menu is an offer for a contract by you,” Downing wrote. “I accepted the offer.”
