A federal appeals panel has removed a judge from a 41-year-old case brought by a Native American tribe against government officials in Utah after likening the case to the fate of Sisyphus, the Greek mythological figure who was condemned for eternity to roll a rock up a mountain, only to have it roll back down.
“We’re beginning to think we have an inkling of Sisyphus’s fate,” wrote Judge Neil Gorsuch on Tuesday in the U.S. Court of Appeals for the Tenth Circuit’s seventh opinion in the case. “Over the last forty years the questions haven’t changed — and neither have our answers. We just keep rolling the rock.”
