U.S. Supreme Court veteran litigator Paul Clement’s first foray into a military appellate court did not end well, but he may soon be in more familiar territory with his Marine client’s religious discrimination case.

The former George W. Bush solicitor general represented Marine Lance Corporal Monifa Sterling in her appeal to the U.S. Court of Appeals for the Armed Forces. The appellate court on Aug. 10 rejected Sterling’s claim that her rights under the Religious Freedom Restoration Act were violated when she was court-martialed for disobeying orders to remove three pieces of paper with a Bible-inspired verse posted around her shared workstation.
