Taking on a new target after defeating one George W. Bush nominee to an appeals court, an influential liberal organization is urging the rejection of D. Brooks Smith, the president’s nominee to the U.S. Court of Appeals for the 3rd Circuit.

But it appears unlikely that Democrats on the Senate Judiciary Committee will block Smith’s appointment as they did last month in the case of 5th Circuit nominee Charles Pickering Sr.
