Crowell & Moring Wins Clients $6 Billion in Damages Over Airliner Bombing

U.S. District Judge Henry Kennedy ordered Libya and six of its officials Tuesday to pay roughly $6 billion in damages to the families of Americans killed in the 1989 bombing of a French airliner. The case stems from the suitcase bombing of UTA Flight 772, which caused the airplane to crash in central Niger, killing all 170 passengers and crew on board. Significantly, Crowell & Moring says this is the first case in which Libya appeared in court and had attorneys defend the case through final judgment.

O'Melveny Dressed Down by Judge, but Cleared for MySpace Case

A federal judge in Los Angeles has refused to disqualify O'Melveny & Myers from representing MySpace in a copyright case but ordered the firm to pay attorney fees to Universal Music Group after calling elements of its conflict waiver "unworthy of a distinguished law firm." In its disqualification motion, UMG had argued that documents sought in the current case were substantially related to previous litigation in which O'Melveny had represented UMG.

Shearman & Sterling Frankfurt Chief Takes Capital Markets Role

Shearman & Sterling's Frankfurt managing partner, Stephen Hutter, is standing down from the management position to take on a new role as head of the firm's Europe & Asia capital markets practice. Hutter, who has headed up the local operation since 1995, will take on the new role on Jan. 1. Hutter's appointment marks the first time a German-based partner has led the capital markets group. Dusseldorf tax consultant Reinhard Stockum is expected to replace him as head of the Frankfurt office.

Herbert Smith Rolls Up for British American Tobacco's $4 Billion Danish Deal

Herbert Smith has bagged a plum role advising regular client British American Tobacco on its $4.07 billion acquisition of businesses from Danish tobacco giant Skandinavisk Tobakskompagni. The deal, which is subject to European Commission approval and is expected to be completed later this year, will see BAT buy up a number of Skandinavisk's smokeless and roll-your-own tobacco interests. Scandinavisk is being advised by "big four" Danish firm Kromann Reumert.

Ex-Partner's ERISA Claim Against Holland & Knight Is Dismissed

A Manhattan federal judge has dismissed an ERISA claim against Holland & Knight by a former partner who alleged he was expelled from the firm because of his age. In his 2005 lawsuit, John K. Weir claimed the firm had terminated his employment at age 55 partly to avoid paying him retirement benefits under its ERISA plans. The judge found the claims barred by the two-year statute of limitations, which tolled from the time of Weir's 2002 termination, not the ending of his benefits two years later.

Trial Date Set in Weil Gotshal Malpractice Matter

A Manhattan judge has set a May 5 trial date for a legal malpractice suit against Weil, Gotshal & Manges. The long-running case stems from the firm's representation of a mall boutique in an unfair competition suit against Italian fashion house Fendi. A jury awarded the boutique a disappointing $110,000 in damages in 2000 and its owners subsequently sued Weil Gotshal, claiming the firm was conflicted because fashion label Prada, which bought a controlling interest in Fendi in 1999, was also a client.

It's been a quick rise for Laura Spiegelman, who last week, at the age of 32, made partner at Morrison & Foerster. In the past Spiegelman has done research for biotech companies and worked in house at a company that developed therapies to fight cancer. Infused by that experience, her current practice focuses on licensing and corporate partnering for life sciences and biotech companies.
