A divorcing husband who said he had a conversation with the staff of his wife's attorney about the case failed to convince a judge that the attorney was conflicted.

Monroe County Supreme Court Justice Kenneth Fisher (See Profile) called the disqualification bid from John Bernacki Jr., an attorney who also is a Pittsford Town Justice, “palpably without merit.”

In Bernacki v. Bernacki, 10787/2014, Fisher said it was “establishe[d] beyond peradventure” that John Bernacki contacted a number of divorce lawyers in order to disqualify them from representing his wife.
