Following a judge's decision ordering him to act, Gov. Andrew Cuomo said Tuesday he will announce a special election to fill the seat vacated by former New York Congressman Michael Grimm.

Cuomo said in a release he would announce the special election for the vacant 11th Congressional district seat “shortly.” The statement came after Eastern District Judge Jack Weinstein (See Profile) issued an opinion Tuesday saying he was giving the governor until Friday to set the election—or the judge would do it himself.

“The right to representation in government is the central pillar of democracy in this country,” Weinstein wrote in Rossito-Canty v. Cuomo, 15-cv-0568. “Unjustified delay in filling this vacancy cannot be countenanced.”
