A federal judge has declined to dismiss a suit against the operators of a Caribbean resort by the widow of an upstate New York man who died while on vacation, finding that she made a plausible initial argument.

Northern District Judge Gary Sharpe (See Profile) denied dismissal motions from Allegro Resorts Marketing and Occidental Hotels Management in Marcy v. Allegro Resorts Marketing, 1:14-cv-398.
