A Long Island attorney who was among six attorneys sentenced in federal court in 2013 for their involvement with a mortgage fraud scheme was disbarred on Wednesday.
New York lawyers are automatically disbarred upon a conviction of a state felony or of a felony in another jurisdiction that is equivalent to a New York offense.
“For purposes of this determination, the felony in the other jurisdiction need not be a mirror image of the New York felony, precisely corresponding in every detail, but it must have essential similarity,” a five-judge panel of the Appellate Division, Second Department, wrote in Matter of Berkowsky, 2014-05936.
