A messenger fired for carrying a bag with the words “God Jehovah's Word Jesus” on it, violating the company's uniform policy, did not state a claim for religious discrimination, the Appellate Division, First Department, said Thursday.
Plaintiff Pedro Antonio Rivera “failed to show that EarlyBird Delivery Systems discriminated against him when it terminated him for failing to comply with its dress code,” a unanimous panel said in an unsigned opinion.
The ruling affirmed Justice Julia Rodriguez's dismissal of the case Rivera v. EarlyBird Delivery Systems, 7079/05.
