A divided appellate panel upheld a second-degree murder conviction for a man who insisted that he was misidentified as the shooter in a 2008 Brooklyn murder and claimed his trial attorney provided ineffective assistance because he did not offer an alternative defense.

The Appellate Division, Second Department, ruled 3-2 to uphold the December 2010 murder and assault convictions for Prince Clark.

Clark is serving a prison sentence of 20 years to life for the killing of Jamel Wisdom and five years for the shooting of Gamard Talleyrand, who survived his injuries and testified involuntarily. The sentences are being served consecutively.
