A new trial should be held in a personal injury lawsuit to determine whether the owner and the driver of a taxi are liable for injuries to a passenger in another taxi, an appellate court ruled.

Plaintiff Fernanda DeSouza filed a complaint after being hurt on June 8, 2010 while allegedly riding in the back of a taxi that collided with another taxi at a red light on Broadway at its intersection with 64th Street.

In their reply, cab driver Ahammad Reja Khan and cab owner Korban Ali admitted their taxi had collided with another vehicle at Broadway and 64th, but denied knowing if DeSouza was actually in their vehicle at the time.
