A Brooklyn appeals court has ordered a new trial for a man who was convicted five years ago for a New Year's Eve murder because a trial judge allowed testimony regarding an unrelated shooting involving the man's identical twin brother to be admitted in the case.

The Appellate Division, Second Department, in People v. Grigoroff, 23/09, upset the jury's 2010 conviction of Anthony Grigoroff for second-degree murder, second-degree criminal possession of a weapon and second-degree attempted burglary.
