Settlement talks are set for later this week in a case where parents sued Orange County and the local school district because their 5-year-old daughter was interviewed about an unfounded child sexual abuse report outside of their presence.

Marie Condoluci and Steven Phillips are seeking $2 million in damages for the incident, in which their daughter was pulled from her kindergarten class at the Scotchtown Avenue Elementary school in Goshen and then questioned for 20 minutes without their permission in 2009.

The parents, who elected to go public with their case to clear their reputations, filed suit in the Southern District against the county, the school district and the village of Goshen. Judge Sidney Stein gave their case a boost in August by granting them summary judgment against the county based on its unreasonable seizure of the child.
