A New York business law that bars merchants from charging customers surcharges for using credit cards has been found constitutional by a federal appeals court.

Reversing a lower court judge who called General Business Law §518 “incomprehensible,” the U.S. Court of Appeals for the Second Circuit said Tuesday the law violates neither the First Amendment nor the Due Process Clause.

Judges Richard Wesley, Debra Ann Livingston and Susan Carney in Expressions Hair Design v. Schneiderman, 13-4533, vacated an injunction against the law imposed by Southern District Judge Jed Rakoff in 2013.
