A divided appellate court reversed a judge who found a man fighting his almost 30-year-old sex abuse conviction was entitled to “every piece of paper” generated in the notorious criminal case.

The 3-1 majority in the Appellate Division, Second Department, turned back Jesse Friedman's records request on Wednesday, saying the statements of non-testifying witnesses were confidential and there was no particularized need to divulge grand jury proceedings.

“We decline to depart from our established jurisprudence, which holds that the statements of nontestifying witness are confidential and not disclosable under [the Freedom of Information Law],” the unsigned majority said Friedman v. Rice, 2013-08373.
