The man who was given a life sentence for working with Osama bin Laden to orchestrate the deadly 1998 bombings of two U.S. embassies in east Africa was ready to argue on appeal Monday that prosecutors have not produced clear evidence linking him to a terrorist plot.

Meanwhile prosecutors in briefs contend that, while Khalid al-Fawwaz did not execute the attacks, he played a key role in al-Qaida's conspiracies by undertaking tasks such as distributing bin Laden's 1996 declaration of war against the United States and serving as the leader of the terrorist group's cell in Kenya.

Oral arguments for al-Fawwaz's appeal in United States v. al-Fawwaz, 15-1731-cr, were held Monday before a panel from the U.S. Court of Appeals for the Second Circuit consisting of Judges Rosemary Pooler, Richard Wesley and Susan Carney.
