A 27-year delay in charging a man with murdering a teenager he allegedly pushed from a rooftop was “not unreasonable,” given the reason for the delay and the advent of DNA testing, a Bronx judge has ruled.
The New York City Police Department “should be lauded, rather than faulted” for reopening the 1989 cold case after “both DNA testing and the DNA databases had developed to a point that enabled the DNA match” between the defendant and fingernail clippings found when a detective examined an old case file, wrote Bronx Supreme Court Justice Steven Barrett on May 24.
