Public comment is being sought on a plan to establish a “large complex case list” to help the Commercial Division manage matters involving more than $50 million.

The recommendation comes in response to the creation of a similar financial list in 2015 by the London Commercial Court, a leading competitor to the Commercial Division as a forum for complex commercial cases. The list would likely be piloted in Manhattan and expanded as appropriate.

According to the Commercial Division Advisory Council, the list is essentially a special docket limited to cases in which at least $50 million is at issue, exclusive of punitive damages, interest, costs, disbursements, and counsel fees.
