The Eastern District U.S. Attorney's Office has reversed its stance and will not appeal a judge's decision to vacate a death sentence for a man convicted of murdering two police officers.

Eastern District Judge Nicholas Garaufis threw out Ronell Wilson's death sentence for the 2003 killings of undercover detectives Rodney Andrews and James Nemorin last year. The judge found Wilson ineligible for capital punishment because he was intellectually disabled in the eyes of the law.

Prosecutors soon filed notice saying they would challenge the decision. But on Monday, Acting Eastern District U.S. Attorney Bridget Rohde said that “after further consideration of all the pertinent legal issues,” the government would not appeal Garaufis' findings.
