Martin Tankleff, who spent 17 years in prison before his conviction for his parents' murders was overturned and his charges were dismissed, is headed to court with his lawsuit against Suffolk County alleging police officers and county officials violated his constitutional rights.

Eastern District Judge Joanna Seybert on Friday denied Suffolk County's motion to dismiss the case. She also directed the parties to file a joint proposed pretrial order on or before Sept. 8, and to appear for a pretrial conference at 10:30 a.m. Sept. 11.

Tankleff was convicted in 1990 for the murder of his parents two years earlier, when he was 17 years old. The Appellate Division, Second Department, vacated his conviction in 2007 and ordered a retrial. Then-state Attorney General Andrew Cuomo, acting as a special prosecutor, found there was insufficient evidence to bring a new case and moved for dismissal.
