The Commercial Division Advisory Council is seeking public comment on a proposed rules amendment and proposed updates to a stipulation and order form.

The first proposal would amend Section 202.70(d) to add a sample “choice of law” provision for use by parties in commercial contracts. The Advisory Council said the change would reduce litigation over choice-of-law issues and help litigants who would prefer state law to govern their disputes. The Advisory Council also said it would help in “showcasing New York's comprehensive body of predictable and sensible commercial law.”

The second proposal would update the stipulation and order form for model status conferences. It would incorporate the host of changes in Commercial Division rules and practices that have taken place since October 2015—the last time the form was revised.
