An anonymous appellant has been granted a new trial after an Appellate Division, Second Department, panel found the lower court improperly allowed a biased juror to serve during a convicted sex offender's civil confinement trial in 2014.

In the unanimous opinion Wednesday by Justices William Mastro, Cheryl Chambers, Joseph Maltese and Robert Miller, the panel found that Brooklyn Supreme Court Justice Wayne Ozzi made an “erroneous” denial of a challenge to a prospective juror in Matter of State of New York v. G. (Anonymous), 16768/12.

Attorney General Eric Schneiderman's office brought the civil confinement case against the appellant, who appears to be Keith Gordon, who was known as the “Flatbush rapist” after robbing and raping 11 victims in 1991.
