District Judge William Kuntz

Defendant lived in Jamaica until 2013. The Jamaica Constabulary force (JCF) arrested him in 1996 or shooting with intent and illegal possession of a firearm. Held in custody for one year, he was acquitted in 1997. In 2010 JCF detained defendant over two shooting leaving four dead. He was released without charge. Defendant overstayed a 2012 O-2 visa used to enter the United States on Feb. 7, 2013. He made false statements to USCIS in his March 2015 permanent residence application. He also made false statements, about an alias, in his O-2 visa application and 2009 tourist visa application. In 2016 defendant was found guilty of visa fraud. Discussing the factors in 18 USC §3553(a) the court sentenced him to 12 months of incarceration served, and three years' supervision. More than ample evidence in the visa fraud trial established preponderant evidence JCF had probable cause to arrest defendant for the 1996 shooting. In sentencing above the Guidelines suggested term of zero to six months, the court noted that lying to American immigration authorities about prior arrests for shootings and lying to American immigration authorities presents a serious challenge to national security and principled law enforcement.
