Erie County Supreme Court Justice Deborah Chimes on Thursday afternoon denied an application for a preliminary injunction filed by partner Stephen Barnes and vacated a temporary restraining order in the acrimonious break-up of personal-injury law firm Cellino & Barnes.

Chimes had approved the temporary restraining order earlier this week but vacated it Thursday on the basis that Barnes had not established a “likelihood of success on the merits, irreparable harm or equities tipping in Barnes's favor,” Terrence Connors, a lawyer for partner Ross Cellino Jr., said in an email.

After days of back-and-forth allegations of poaching and bullying filed in court documents, Barnes' lawyers asked the court for a gag order to stymie some of the accusations being levied, but Chimes denied the request.
