A trial court in New York, in a Superstorm Sandy insurance coverage case, has refused to dismiss an insured's lawsuit against his insurance carrier as untimely, finding both of his insurance policies unclear as to the time by which he had to file a lawsuit.

Steven Swarzman alleged that his home at 277 Surfside Drive in Bridgehampton, New York, was damaged by Superstorm Sandy on October 29, 2012.
