Deutsche Bank and Capital One have agreed to halt document production in response to the subpoenas issued by two U.S. House of Representatives committees seeking detailed financial information about President Donald Trump, his family and his businesses, according to documents filed in federal court late Wednesday.
The same filings indicated the suit will likely soon be joined by attorneys for the House Democrats, whose counsel intends to file a motion to intervene before week's end.
Additionally, the parties have agreed to an expedited filing schedule on a preliminary injunction motion the Trump plaintiffs say they will file no later than Friday.
U.S. District Judge Edgardo Ramos of the Southern District of New York signed off on the order setting the briefing schedule for the parties. After counsel for the House and the Trump plaintiffs file their motions by Friday, the opposition will have a week to respond. A reply brief deadline is now set for May 15. A hearing before Ramos is scheduled for 2:30 p.m. May 22.
In a separate filing, Trump's attorneys stated that the office of House general counsel Douglas Letter agreed to suspend the May 6 production deadline set by the subpoenas issued by the two House committees—the House Intelligence Committee, chaired by Rep. Adam Schiff, D-California, and House Financial Services Committee, chaired by Rep. Maxine Waters, D-California.
The parties agreed to move any deadline to seven days after the district court makes a decision on the motion for preliminary injunction, which, given the new schedule, won't happen until the end of May at the earliest.
Both Deutsche Bank and Capital One agreed not to produce material responsive to the subpoenas during the time period, according to a filing by the Trump plaintiffs, “thereby avoiding the need for a TRO or other emergency proceedings.” Ramos' signed ordered reiterated the production halt.
