Second Department Reinstates Claims Against LI Firm Accused of Dual Representation
Cullen and Dykman is accused of improperly collecting "hundreds of thousands" of dollars from a client while also working as corporate counsel for her opponent.

A Brooklyn state appeals court has revived a lawsuit seeking to recover legal fees from a Garden City, New York-based law firm accused of betraying its client's interests.
The New York Supreme Court, Appellate Division for the Second Department on Thursday said a representative of plaintiff Phebe Baugher's estate could proceed with claims that the firm Cullen and Dykman had improperly collected “hundreds of thousands” of dollars from Baugher while also working as corporate counsel for her opponent.
The ruling reversed a 2016 trial court decision from Supreme Court Judge Jerome C. Murphy, which found that the prior representation, which found that Baugher had not alleged any actual damages she suffered as a result of the firm's conflicted representation.
