Mark Lebovitch, a partner at Bernstein Litowitz Berger & Grossman who heads the firm's corporate governance litigation practice, is this year's recipient of the New York Law Journal's Attorney of the Year award.
Lebovitch is the attorney behind several high-profile cases involving the rights of shareholders, like one against Fox News over claims of sexual harassment and discrimination at the network.
That wasn't always his strategy in life; Lebovitch will tell you he's never had a five- or 10- year plan, but he's always had an eye toward innovation and the spirit of an entrepreneur. That's what drove him to launch the corporate governance practice at Bernstein Litowitz.
Ironically, Lebovitch never saw himself pursuing a career in the legal profession, at least in the long-term. His plan was to practice law long enough to pay off his student loans, then switch to some kind of entrepreneurial work, like a tech company.
That changed when Lebovitch took a class on corporate law while he was studying at NYU Law School in the late 1990s. He later clerked with Stephen Lamb, vice chancellor of the Delaware Court of Chancery. The rest is history.
Lebovitch has worked for more than a decade at Bernstein Litowitz, where he's yet to shy away from a challenging case on behalf of investors.
Lebovitch, in recent years, led a case against the parent company of Fox News on behalf of shareholders over claims that the network allowed a persistent culture of sexual harassment and discrimination. That resulted in a $90 million recovery for shareholders and stronger oversight at the network.
In another case, Lebovitch represented shareholders in a lawsuit against Yahoo over the company's failure to disclose a major data breach. Lebovitch argued, successfully, that the company's actions put its investors at risk. The case ended with a $29 million recovery.
His firm's corporate governance practice, which was nonexistent before Lebovitch pushed it to grow, got another boost this year. Bernstein Litowitz is now opening an office in Delaware, one of the most important jurisdictions for corporate governance litigation in the country.

Driscoll from Wilmer Cutler Pickering Hale and Dorr have stepped in to represent Symbotic Inc., an A.I.-enabled technology platform that focuses on increasing supply chain efficiency, and other defendants in a pending shareholder derivative lawsuit. The case, filed Oct. 2 in Massachusetts District Court by the Brown Law Firm on behalf of Stephen Austen, accuses certain officers and directors of misleading investors in regard to Symbotic's potential for margin growth by failing to disclose that the company was not equipped to timely deploy its systems or manage expenses through project delays. Edmund Polubinski and Marie Killmond of Davis Polk & Wardwell have entered appearances for data platform software development company MongoDB and other defendants in a pending shareholder derivative lawsuit. The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments. The case is 1:24-cv-07594, Roy v. Ittycheria et al.

The suit was filed Sept. 7 in Wisconsin Western District Court by Levine Eisberner LLC and Siri & Glimstad on behalf of a project manager who claims that he was wrongfully terminated after applying for a religious exemption to the defendant's COVID-19 vaccine mandate. The case, assigned to U.S. Magistrate Judge Anita Marie Boor, is 3:24-cv-00630, Secker, Nathan v. Epic Systems Corporation.

David X. Sullivan, Thomas J. Finn and Gregory A. Hall from McCarter & English have entered appearances for Sunrun Installation Services in a pending civil rights lawsuit. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M. Berke on behalf of former employee George Edward Steins, who was arrested and charged with employing an unregistered home improvement salesperson. The complaint alleges that had Sunrun informed the Connecticut Department of Consumer Protection that the plaintiff's employment had ended in 2017 and that he no longer held Sunrun's home improvement contractor license, he would not have been hit with charges, which were dismissed in May 2024.
