An upstate New York judge threw out a lawsuit Monday that aimed to release a group of state prisoners over COVID-19 concerns.

The suit from The Legal Aid Society and Kasowitz Benson Torres argued the prisoners’ confinement violated their rights under the Eighth Amendment and the state constitution, due to their vulnerability to the virus. It argued the inmates were particularly vulnerable to COVID-19 due to their age or underlying medical condition.
