A three-judge court could be required to review a challenge led by New York state Attorney General Letitia James aimed at blocking President Donald Trump’s move to exclude undocumented immigrants from the U.S. census count, a Manhattan federal judge said Wednesday in setting an expedited briefing schedule for the case.

States and cities are seeking to halt Trump’s July 21 order directing the U.S. Commerce Department not to include unauthorized immigrants in the constitutionally mandated count for Congressional redistricting. They argue it violates constitutional provisions and statutes governing the decennial head count.
