A panel of the U.S. Court of Appeals for the Second Circuit appeared disinclined Tuesday to require additional public health data from Gov. Andrew Cuomo in a Brooklyn tavern's challenge to state rules forcing bars and restaurants to close early in order to fight the spread of COVID-19.

The arguments came as officials continue to assess the viability of indoor dining in New York City, and across the state, amid a second wave of the novel coronavirus, which so far has claimed more than 284,000 lives in the United States.
