Attorneys from the New York Civil Liberties Union and Bronx Defenders have alleged that U.S. Immigration and Customs Enforcement officials are violating a federal court order by continuing a “no-release” policy of detaining undocumented immigrants arrested over the last three years.

In court papers filed late Dec. 18, the groups said they had learning in a recent deposition that ICE was still using a risk assessment tool that it had allegedly rigged in 2017 to unlawfully classify undocumented, long-time residents as “high risk” in order to prevent their release from federal custody.
