The Legal Aid Society on Wednesday filed a second lawsuit to compel New York state officials to expand COVID-19 vaccine eligibility to all incarcerated people in the state, arguing that the failure to do so contradicts federal public health guidance and the officials’ own stated goal of ensuring racially equitable access to the vaccine.

The state has expanded eligibility to people living in other congregate facilities, including homeless shelters and health care facilities, but incarcerated adults have been excluded despite facing similar risks, the Legal Aid attorneys argued.
