A Cayuga County town court justice has resigned amid investigation into allegations that he had harassed two women and improperly advised a criminal defendant on how to avoid having his guns confiscated, a New York state disciplinary panel announced Friday.

The State Commission on Judicial Conduct said in a statement that it had begun investigating the former Judge Mark DiVietro of the Owasco Town Court, last summer after allegations surfaced that he had repeatedly sent texts to his then-girlfriend that contained threats regarding a former love interest.
