In an opinion addressing both New York State freedom of information law and New York City’s conflict of interest law, an appeals court has ruled that Mayor Bill de Blasio’s office must turn over to The New York Times a private warning letter issued to de Blasio’s office by the city’s Conflicts of Interest Board.

New York State’s appellate division court focused much of its ruling on whether, under a state Freedom of Information Law analysis, a section of the City Charter’s chapter 68, which codifies its conflicts of interest law, created a statutory exemption to FOIL’s presumption that a letter possessed by a city agency should remain available to the public.
