Harvey Weinstein, the disgraced movie mogul and convicted rapist, will be extradited from a New York prison to await trial in California despite his attorney’s claims of invalid paperwork, a Buffalo, New York, judge determined at a hearing Tuesday afternoon.

Erie County Judge Kenneth Case also wasn’t swayed by Weinstein attorney Norman Effman’s arguments that Weinstein could receive better medical treatment in the Wende Correctional Facility, where he is serving a 23-year sentence for third-degree rape and a criminal sexual act, than in a Los Angeles jail.
