A group of upstate New York parents allege in a federal suit filed in the Northern District of New York that state Health Commissioner Howard Zucker’s mask mandate for K-12 students is not only ineffective at stopping the spread of COVID-19, it also inhibits their speech.

The complaint was filed by Thomas Marcelle and other lawyers on behalf of a group of parents who dispute the efficacy of wearing masks for protection against infection, and claim the mandate threatens civil liberties. The case is 1:21-cv-01034, L.T. et al v. Zucker.
